If you have inherited a property from a family member or friend, you may find it upsetting to visit the house. Many of the tasks you need to do can be safely given to others. You may find it helps if you sit down and make a list of things to be done, such as clearing the house, or updating it for sale. Make a list of jobs to do from start to finish and got through this with a trusted friend or family member. Decide which jobs you really need to do yourself and which can be safely carried out by others. If you are using builders or other trades always get three quotes. You may find it helps if you visit the property with a supportive family member or friend. Also remember that cleaners, house clearers and builders won’t be upset by what they find at the house.

You need to decide what to do with the property, for example sell it, or rent it out, or have another family member moves in.  Once you have done this, you will likely feel relief and be more positive and able to move on with your life.

Solicitors lose Share of probate Market

The Legal profession’s share of the lucrative probate market has dipped sharply, with solicitors and those companies who provide services for those seeking probate in 2012 received a mere 44% of all probate grants issued, according to figures published today. The 2011 data from the Probate Service (HMCTS), shows grants issued to solicitors fell nearly 30% between 2006 and 2010 and that the majority of 2010 grants went to individuals (56%). This according to Kevin Cole head of research at Title Research, the probate and people tracing company. Kevin's data indicates that the number of wills coming to probate in 2011 that had failed to appoint an executor or had appointed an executor who was unable or unwilling to administer the estate had risen by 5% on 2010 to 15,553. www.inheritedproperty.co.uk has many enquiries from people who poorly advised or suffering diy probate problems. This week is national will writing week. Its important to make a will because if there is no will the deceased assets are distributed according to the rules of intestacy instead of personal wishes. Its important to have a will to ensure your beneficiaries are not subject to financial and emotional stress that can result from intestacy. Land registry inherited property search

Land Registry new guide to help inherited property search

The land registry has launched a new service and a guide to searching the index of proprietors’ names. In other words the land registry can help persons search for all the property owned by an individual. If you are an executor or your solicitor is acting as an executor they can for a fee of £12 search all land registry records for property belonging to the deceased. This may be helpful if you are unsure of the assets or liabilities of the deceased.

The Land Registry 's new guidance on searching for property belonging to an person or coproration in the Index of Proprietors’ Names (IOPN). The guide is called Practice Guide 74 – Searches of the Index of Proprietors’ Names . The guide explains how to  search the index.   Anyone can search the IOPN to find properties in: · their name · the name of a  company · the name of some other person in whose property they can satisfy the registrar that they have a general interest. For example: . the Official Receiver or a trustee in bankruptcy can search against the name of the bankrupt . a personal representative may search against the name of the deceased on production of probate or letters of administration. · the name of a private individual if they have a court order authorising an IOPN search · the name of a private individual if they have the written authority of the person being searched. What does probate cost?

What does probate cost? Well according to a recent Sun-Life survey the average cost of probate in the UK is £2,292. However more and more people are investigating the possibility of using DIY probate kits or specialist fixed fee probate solicitors. Certainly if the probate process is simple then the financial advantages are obvious. Traditionally family solicitors make their money when their clients die, by handling the probate and conveyancing process. Sadly this can lead to high charges.
